Two Processing Streams
Expedited Hearing
e.g. Christmas access, temporary/interim parenting issues, temporary/interim child and spousal support, house possession after separation
- Legal documents (affidavits) not required but may be provided
- Attend with or without counsel
- Both parties under oath during the hearing
- Both parties receive equal time discussing/presenting their case to the Arbitrator
- Obtain a hearing in as quick as 3 days
- Written decision (abbreviated reasons) and draft Consent Order provided within 48 hours of hearing
Regular Hearing
e.g. Full parenting plans, one parent wants to move with the children, child support, spousal support, property division issues
- Legal documents (Affidavits, legal brief, case law) required (unless special permission given)
- Lawyers required (unless special permission given)
- Both parties under oath during the hearing
- Both parties receive equal time discussing/presenting their case to the Arbitrator
- Obtain a hearing in as quick as 25 days
- Written decision (abbreviated reasons) and draft Consent Order provided within 7 days of hearing
